Terms & Conditions

Sponsored Challenge Booking

Challenge is being booked with Carls 3 Peak transport (as from now known as “the organiser”). If you are a sponsored participant this does not affect the fact that you are liable for the full cost of the Challenge. The organiser will only refund monies as per the “Cancellation Schedule”.

Deposit

At the time of booking the Challenge a deposit of £99.00 per person is required.

Payment can be made by cheque (payable to Carlsminibus), cash or BAC’s transfer. We must receive the full balance payment 8 weeks prior to departure. A 3% fee will be charged for any payments made by credit card.

Cancellation charges

When we receive your booking application we will start to make arrangements to provide the Challenge. We can usually cancel these arrangements if you provide enough time by cancelling your booking well in advance. The closer you get to the date of the Challenge the harder the arrangements are to cancel. The services that we have reserved on your behalf will have to be cancelled. We have developed the “Cancellation Schedule”. Please make sure you inform us in writing or via email that you no longer wish to participate in the Challenge. Below is the costing of Cancellations.

CANCELLATION SCHEDULE

  • More than 8 weeks prior to the Challenge: Loss of Booking Fee or deposit only.
  • Between 8 and 6 weeks prior to the Challenge 50% of the total cost.
  • Between 6 and 4 weeks prior to the Challenge 75% of the total cost.
  • Within 4 weeks to the Challenge: You will be liable for the full cost of the trip.

The organiser will issue a Cancellation Reference which you should keep for your future. All cancellation charges WILL be charged. They are charged by Carlsminibus and NOT the charity.

Insurance

Accidents on the challenge due to the nature are possible and the client must be aware of the risks. The client must take out Insurance to protect him/her from loss of earnings, profit or any indirect, special or consequential loss, damage, cost, expenses or claims whether caused by the negligence of The organiser or its agents, servants or otherwise, which arise out of or in connection with the provision of the Challenge or their use by the Client.

The organiser is not liable to the Client or deemed to be in breach of the Contract by reason of any delay in performing, or any failure to perform, any of the organiser’s obligations to the Client.

The entire liability of organizers under or in connection with the Contract shall not exceed the amount of the organiser’s charges for the provision of the Challenge.

For loss of baggage or personal effects or simple accidents you are NOT insured. You must take out your own insurance cover for such things as loss of baggage and personal effects.

Medical

You CANNOT participate in this Challenge if you are pregnant nor have ANY problems with your heart, regardless of what your doctor may say. Before you are accepted onto any Challenges you must confirm that you have no medical or other conditions that may in any way affect your participation in the Challenge and that you will notify the organiser should such a condition become apparent after your booking has been accepted.

This Is For Your Own Safety and The Safety Of Others.

Age

We only accept bookings from people who are over 18 years old on the first day of the Challenge unless the child is accompanied by a parent or legal guardian.

Amendments

Due to the nature of the Challenge the organiser reserves the right to amend the itinerary at any time. In the unlikely event of this happening these will usually, but not necessarily exclusively, be minor changes. No compensation will be payable. The organiser will always endeavour to maintain the quality of the offer if changes have to be made.

The organiser reserves the right to cancel the Challenge for any reason. These may include, but are not exclusive to:

  • for reasons beyond the control of the organiser;
  • a minimum group number has not been reached;
  • Non-payment by the Client of the due sum by the due date. If the Client does not pay the balance by the due date, the organiser reserves the right to cancel the Client’s booking and take legal action to retrieve any outstanding balances. The organiser will not be liable for any incidental expenses the Client may have incurred.
  • Should the client wish to change an existing booking with the organiser, then an administration charge will apply. A change of an existing booking (e.g. changing from one date to another) may only be made with the agreement of the organiser and the amendment charge will be £35.

General

The Client will in certain situations during the Challenge be led by guides and the Client agrees that their decision is final (including regarding their continuing participation in the Challenge) and will be guided by them in all situations.

The organiser reserves the right to reject any member of the Challenge at any time. For reasons such as irresponsible, criminal behaviour or any actions which endangers the safety of the guide or any other member of the group. If this happens the organiser will accept no further liability or responsibility to that member or members.

The Organiser deals with the Client who will accept responsibility for any damage or loss caused by the Client or any member of the Client’s party to property of the organiser or any third party. Payment for such damage or loss must be made at the time direct to the appropriate person or persons. If the Client cannot make recompense for their actions at the time then they must indemnify the organiser against any claims, including legal costs, that may subsequently be made against the organiser as a result of their actions.

Complaints must be filed 7 days of completion of the Challenge otherwise then the Challenge will be accepted as satisfactorily supplied.
